1. Agreement to Terms
By accessing or using the MineralBalance website (mineralbalance.com) and purchasing our services, you agree to be bound by these Terms of Service (“Terms”). If you do not agree to these Terms, please do not use our services.
These Terms constitute a legally binding agreement between you and MineralBalance (“we,” “us,” or “our”). We reserve the right to modify these Terms at any time. Changes will be effective upon posting to our website. Your continued use of our services following any changes constitutes acceptance of those changes.
2. Services Overview
MineralBalance provides Hair Tissue Mineral Analysis (HTMA) testing services, which include: at-home hair sample collection kits, laboratory analysis through our partner Analytical Research Labs, comprehensive test reports, educational content and video courses, personalized health protocols (Gold and Platinum packages), and consultation services (Gold and Platinum packages).
Our services are designed to provide information about mineral status and toxic metal exposure. They are intended for educational and informational purposes.
2.2 Supplement Products
MineralBalance may offer dietary supplements for purchase. These products are intended to support general wellness and are not intended to diagnose, treat, cure, or prevent any disease. Supplement availability, pricing, and formulations are subject to change without notice.
3. Eligibility
You must be at least 18 years old to purchase our services. If you are purchasing services on behalf of a minor, you represent that you are the parent or legal guardian of that minor and consent to the collection and use of their information as described in our Privacy Policy.
By using our services, you represent that: you are at least 18 years of age, you have the legal capacity to enter into these Terms, you will provide accurate and complete information, and you will comply with all applicable laws and regulations.
4. Account Registration
Some features of our services may require you to create an account. You are responsible for: maintaining the confidentiality of your account credentials, all activities that occur under your account, notifying us immediately of any unauthorized use, and ensuring your account information is accurate and current.
We reserve the right to suspend or terminate accounts that violate these Terms.
5. Orders and Payment
5.1 Pricing
All prices are listed in US dollars and are subject to change without notice. Prices displayed at the time of purchase will be honored for that transaction.
5.2 Payment
We accept major credit cards and other payment methods as displayed at checkout. Payment is processed securely through our third-party payment processor. By submitting payment, you represent that you are authorized to use the payment method provided.
5.3 Order Confirmation
Upon placing an order, you will receive an email confirmation. This confirmation does not constitute acceptance of your order. We reserve the right to refuse or cancel any order for any reason, including product availability, errors in pricing or product information, or suspected fraud.
6. Shipping and Delivery
6.1 Shipping
We ship HTMA test kits to addresses within the United States and Canada. Orders typically ship within 24 hours of purchase. Delivery times vary by location, typically 2-5 business days.
6.2 Risk of Loss
Risk of loss and title for items purchased pass to you upon delivery to the carrier.
6.3 Sample Return
You are responsible for returning your hair sample using the prepaid envelope provided. We are not responsible for samples lost in transit. Results are typically available within 10 business days of the laboratory receiving your sample.
7. Service Packages and Upgrades
7.1 Package Tiers
We offer three service tiers: Silver ($197), Gold ($497), and Platinum ($1,197). Each package includes different levels of service as described on our website at the time of purchase.
7.2 Upgrade Policy
Customers who purchase the Silver package may upgrade to Gold or Platinum within 30 days of receiving their test results. Upgrades are applied as a credit—you pay only the difference between packages. This upgrade option expires 30 days after results are delivered.
7.3 Consultation Scheduling
Gold and Platinum packages include consultation services. Consultations must be scheduled within 6 months of receiving your test results. Unused consultations expire after this period.
8. Private Membership Association
8.1 Membership Requirement
Gold and Platinum packages include consultation services that are provided exclusively through The Mineral Balancing Academy, a Private Membership Association (PMA). To receive consultation services, personalized protocols, and related support included in these packages, you must agree to and sign the PMA Membership Agreement.
8.2 Agreement Process
After purchasing a Gold or Platinum package, you will receive the PMA Membership Agreement via email. This agreement must be signed before your consultation can be scheduled.
8.3 Declining Membership
If you choose not to sign the PMA Membership Agreement, you will not be able to receive consultation services or personalized protocols. In this case, you may request a refund of your Gold or Platinum purchase, minus the value of the Silver package ($197), which covers your HTMA test and report.
8.4 Relationship Between Agreements
The PMA Membership Agreement governs the practitioner-member relationship for consultation services. These Terms of Service continue to apply to all other aspects of your purchase, including the HTMA test kit, digital content, and general website use.
9. Refund and Cancellation Policy
9.1 Before Sample Submission
If you have not yet mailed your hair sample, you may request a full refund minus a $25 processing and restocking fee. Contact us to initiate this request.
9.2 After Sample Submission
Once your hair sample has been submitted to the laboratory, refunds are not available as the testing process has begun.
9.3 Service Satisfaction
If you are dissatisfied with the quality of your report or consultation services, please contact us within 14 days of receiving your results. We will work with you to address your concerns, which may include additional consultation time or other remedies at our discretion.
9.4 Digital Products
Access to educational courses and digital content is non-refundable once access has been granted.
9.5 Supplement Returns
Unopened supplements may be returned within 30 days of delivery for a full refund, minus shipping costs. Opened supplements are not eligible for return due to health and safety regulations. Damaged or defective products will be replaced or refunded at our discretion—contact us within 7 days of delivery with photos of the damage.
10. Intellectual Property
All content on the MineralBalance website, including text, graphics, logos, images, videos, courses, reports, and software, is the property of MineralBalance or our licensors and is protected by copyright, trademark, and other intellectual property laws.
You may not: reproduce, distribute, or publicly display our content without permission, modify or create derivative works from our content, use our content for commercial purposes without authorization, or remove any copyright or proprietary notices.
Your purchase grants you a personal, non-transferable license to access and use purchased content for your own personal health purposes only.
11. Health Disclaimer
11.1 Not Medical Advice
MineralBalance services are for educational and informational purposes only. Our services, including HTMA testing, reports, protocols, and consultations, do NOT constitute medical advice, diagnosis, or treatment.
11.2 Not a Substitute for Medical Care
Our services are not intended to replace professional medical advice, diagnosis, or treatment. Always seek the advice of your physician or other qualified health provider with any questions you may have regarding a medical condition. Never disregard professional medical advice or delay seeking it because of information received from MineralBalance.
11.3 No Doctor-Patient Relationship
Use of our services does not create a doctor-patient or practitioner-patient relationship. MineralBalance practitioners are not licensed physicians unless otherwise stated.
11.4 Individual Results
Health outcomes vary by individual. We make no guarantees regarding specific health results from following our recommendations.
11.5 Supplement Recommendations
Any supplement recommendations provided are suggestions based on your test results. You should consult with your healthcare provider before starting any new supplement regimen, especially if you are pregnant, nursing, have a medical condition, or are taking medications.
11.6 Dietary Supplements
The dietary supplements sold by MineralBalance have not been evaluated by the Food and Drug Administration (FDA). These products are not intended to diagnose, treat, cure, or prevent any disease. Results may vary by individual. You should consult with your healthcare provider before using any supplement, especially if you are pregnant, nursing, have a medical condition, take medications, or have known allergies. Review all product labels and ingredient lists before use. MineralBalance is not responsible for adverse reactions resulting from supplement use.
12. Limitation of Liability
To the fullest extent permitted by law, MineralBalance and its owners, employees, partners, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to: loss of profits, data, or goodwill, personal injury or health outcomes, service interruption or computer damage, or any damages arising from your use of our services.
Our total liability for any claim arising from these Terms or your use of our services shall not exceed the amount you paid for the specific service giving rise to the claim.
Some jurisdictions do not allow the exclusion or limitation of certain damages. In such jurisdictions, our liability shall be limited to the greatest extent permitted by law.
13. Indemnification
You agree to indemnify, defend, and hold harmless MineralBalance and its owners, employees, partners, and affiliates from any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys’ fees) arising from: your use of our services, your violation of these Terms, your violation of any rights of another party, or any content you submit or share through our services.
14. Dispute Resolution
14.1 Informal Resolution
Before initiating any formal dispute resolution, you agree to first contact us at [email protected] to attempt to resolve the dispute informally. We will attempt to resolve disputes within 30 days of receiving notice.
14.2 Governing Law
These Terms shall be governed by and construed in accordance with the laws of the Commonwealth of Virginia, without regard to its conflict of law provisions.
14.3 Jurisdiction
Any disputes arising from these Terms or your use of our services shall be resolved exclusively in the state or federal courts located in the Commonwealth of Virginia. You consent to the personal jurisdiction of these courts.
15. Prohibited Uses
You agree not to use our services to: violate any applicable laws or regulations, impersonate any person or entity, submit false or misleading information, interfere with or disrupt our services, attempt to gain unauthorized access to our systems, use our services for any commercial purpose not expressly permitted, or harass, abuse, or harm others.
16. Third-Party Services
Our services may integrate with or link to third-party services, including our laboratory partner Analytical Research Labs. We are not responsible for the practices, content, or availability of third-party services. Your use of third-party services is subject to their respective terms and policies.
17. Termination
We reserve the right to suspend or terminate your access to our services at any time, with or without cause, and with or without notice. Upon termination, your right to use our services will immediately cease. Provisions of these Terms that by their nature should survive termination shall survive, including intellectual property, limitation of liability, indemnification, and dispute resolution.
18. Severability
If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
19. Entire Agreement
These Terms, together with our Privacy Policy and any other policies referenced herein, constitute the entire agreement between you and MineralBalance regarding your use of our services. These Terms supersede any prior agreements or communications.
